Last Will and Testament of Elijah Foote

1812, Wheeling, (W)Va.

 

(Appreviations added by this author for better understanding. Elijah Foot was the father-in-law to John Mozena of Monroe County, Ohio - a Revolutionary War Veteran.)

 

In the name of God, Amen. I, Elijah Foot of Ohio County and Commonwealth of Virginia, being weak in body but of sound and perfect mind and memory blessed be Almighty God for the same, do make & publish this my last will and Testament in manner and form following, to wit, and first of all I commit my body to the ground to be buried in decent Christian burial and my Soul to God who gave it -

2ndly: After my lawful debts funeral charges & care discharged, I give and bequeath to my beloved wife, Mary, all my personal estate, goods, and chattles of what kind or nature so ever, to be disposed of as she may think proper.

3rdly, I also give and devise to my said beloved wife, Mary, all my Real estate, to her only proper use and behoof during her natural life: and further to dispose of the same, or any part thereof if in her Judgment, she is likely to come to want -

4thly, should my said beloved wife Mary, not be necissitated to sell the whole or any part of my Real estate for her support, I give and devise the whole, or whatever part thereof may remain unsold to my beloved Sons, John, Joseph, Amos, and Andrew Foot, to be equally divided between them -

5thly and lastly, I do hereby nominate and appoint my trusty friends, William Wilson and Michael Cox, sole Executors of this my last will and testament, thereby revoking all former wills by me made.

 

In witness whereof I have hereunto set my hand and seal, this seventh day of April in the year of our Lord, eighteen hundred and twelve.

Acknowledged in presence of John H. Wheeler, Junr, Samuel McKechan, Wm Wilson. A true copy from the original which was proven in Court at November Term 1813 by John H. Wheeler & Wm Wilson, two of the subscribing witnesses thereto and ordered to be recorded.
